Terms of Service

1. Agreement

By downloading, installing, or using HiYou.AI ("the app"), you agree to these Terms of Service. If you do not agree, do not use the app.

HiYou.AI is operated by Rahaiz (KVK 99728567), a sole proprietorship registered in the Netherlands.

2. Eligibility

You must be at least 18 years old to use HiYou.AI. By creating an account, you confirm that you are 18 or older. We reserve the right to terminate accounts of users found to be under 18.

3. What HiYou.AI Is

HiYou.AI is an entertainment app that lets you interact with AI-generated characters. Important things to understand:

All characters are fictional. They are generated by artificial intelligence. No real people are depicted.
Characters are not real people. They cannot form real relationships, provide professional advice, or replace human connection.
AI responses are generated, not pre-written. While we design character personalities, individual responses are generated by AI and may occasionally produce unexpected content.
HiYou.AI is not a substitute for professional mental health support, therapy, or counseling.

4. Your Account

You are responsible for:

Keeping your login credentials secure
All activity that occurs under your account
Providing accurate information when creating your account

You may not create multiple accounts, share your account, or transfer your account to another person.

5. Acceptable Use

When using HiYou.AI, you agree NOT to:

Use the app if you are under 18
Attempt to generate content involving minors in any inappropriate context
Use the app to generate content that promotes violence, self-harm, or illegal activities
Attempt to extract, copy, or reverse-engineer character personalities or AI prompts
Use automated tools, bots, or scripts to interact with the app
Exploit bugs or vulnerabilities (please report them to support@hiyou.app)
Harass, threaten, or abuse other users through user-created characters
Use the app for any commercial purpose not explicitly authorized by us

We reserve the right to suspend or terminate accounts that violate these rules.

6. In-App Purchases & Coins

Purchases

HiYou.AI offers in-app purchases including coin packs and premium subscriptions. All purchases are processed through Apple's App Store or Google Play and are subject to their respective terms and refund policies.

Coins

Coins are a virtual currency used within HiYou.AI. They can be used to send gifts, request photos, create characters, and unlock marketplace characters. Coins have no real-world monetary value outside of the app and cannot be exchanged for cash (except through the Creator Payout program, see section 7).

Premium Subscription

Premium subscribers receive benefits including increased message limits, higher quality AI responses, and additional features. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage your subscription through your device's app store settings.

Refunds

Refund requests for in-app purchases are handled by Apple or Google, as they process the payments. Contact their support for refund requests. We do not process payments directly.

7. Creator Program

HiYou.AI allows users to create and publish AI characters on the marketplace.

How It Works

Creating a character costs 500 coins
Published characters can be unlocked by other users
Creators earn 20% of the unlock price when another user unlocks their character
Earnings accumulate in your creator balance

Payouts

Minimum payout threshold: €50
Payouts are processed via PayPal
Payout requests are reviewed and processed within 14 business days
You are responsible for any taxes applicable to your earnings

Content Guidelines for Creators

Characters you create must not:

Impersonate real, identifiable people
Contain hate speech, discriminatory content, or content promoting violence
Be designed to exploit or deceive other users
Violate any applicable laws

We reserve the right to remove characters that violate these guidelines and to suspend creator accounts.

8. Intellectual Property

Our Content

HiYou.AI, including its design, curated characters, AI systems, and branding, is owned by Rahaiz. You may not copy, modify, or redistribute any part of the app without our written permission.

AI-Generated Content

AI-generated messages and images within the app are generated for your personal use within the app. You may not use AI-generated content for commercial purposes outside of HiYou.AI.

Your Content

Messages you send within the app remain your content. By using the app, you grant us a limited license to process your messages for the purpose of generating AI responses and improving our service.

9. Disclaimers

HiYou.AI is provided "as is" without warranties of any kind. We do not guarantee:

That the app will be available at all times without interruption
That AI responses will be accurate, appropriate, or error-free
That characters will behave consistently in all situations
Specific outcomes from using the app

AI characters may occasionally generate unexpected or inappropriate responses despite our content moderation systems. If you encounter problematic content, please report it to support@hiyou.app.

10. Limitation of Liability

To the maximum extent permitted by law, Rahaiz shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of HiYou.AI. This includes, but is not limited to, emotional distress, loss of data, or financial loss.

Our total liability for any claim related to the app shall not exceed the amount you have paid to us in the 12 months preceding the claim.

11. Account Termination

You may delete your account at any time through the app's settings. Upon deletion, all your data will be removed within 30 days in accordance with our Privacy Policy.

Creator characters: If you delete your account, any characters you created and published on the marketplace will be removed. Users who previously unlocked your character will retain access, but the character will no longer be available for new unlocks. Any pending payout balance will be forfeited if below the minimum threshold (€50). If your balance is above the threshold, you may request a final payout before deleting your account.

We may suspend or terminate your account if you violate these Terms. In case of termination for violation, no refund will be provided for remaining coins or active subscriptions.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the app or via email. Continued use of the app after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the competent courts of the Netherlands.
